1. Introduction

These terms and conditions govern the use of services offered by Sky Faze, headquartered at Reykjavik 101, Iceland. By using our services, you accept these terms and conditions in full.

2. Services Overview

Sky Faze specializes in developing high-quality, high-performance web and mobile applications, primarily using React and Next.js. Our services cater to medium-sized businesses and include affordable hosting and top automation services.

3. User Responsibilities

Clients are responsible for providing timely feedback and responses to Sky Faze's requests regarding their projects. Sky Faze is not responsible for delays caused by the client's unresponsiveness.

4. Payment Terms

Payments are accepted via bank transfer, credit card, or PayPal. Full payment is required before project commencement. For projects exceeding €4,000, payment can be split into a maximum of three installments over three months.

5. Cancellation and Refund Policy

Cancellations and refunds are possible if the project has not started, with transaction fees being non-refundable. For ongoing projects, refunds will be based on the amount of work completed.

6. Intellectual Property

Clients retain full access to their deployed website builds, which are fully functional and deployable. However, these builds are production versions (e.g., minified and compiled) and cannot be meaningfully modified or repurposed. The original source code — including all files, logic, and uncompiled assets — remains the exclusive property of Sky Faze.

Access to the source code allows for full reuse, resale, customization, and deployment across future projects. Clients who wish to acquire full rights to the source code may do so via a one-time fee. For e-commerce websites, the maximum fee is 1,500,000 ISK. For small business websites (Next.js, up to 10 pages), the typical fee is approximately 350,000 ISK. For larger non-ecommerce applications with extensive content or blog systems, the price can be around 750,000 ISK.

Upon full payment, the client obtains complete ownership and unrestricted rights to the original source code. Until then, all source code remains the intellectual property of Sky Faze. While clients have access to the deployed build folder, this production version is not editable and cannot be repurposed, reused, or resold in any form. Only the source code enables full customization, modification, or redeployment rights — and those rights are only granted upon purchase.

7. Liability and Indemnification

Sky Faze is not responsible for the content clients upload to their websites post-delivery. Clients assume all responsibility for their website's content and use.

8. Dispute Resolution

Disputes are resolved through communication via email (info@skyfaze.com). We are governed by Icelandic law.

10. Hosting Service Changes

Sky Faze previously provided free hosting for small and non-ecommerce Next.js projects. As part of an ongoing service adjustment, a small monthly hosting fee will be introduced starting from September 23, 2025. This update aligns with our shift toward sustainable, high-quality service and reflects the growing demand for modern, maintained deployments.

Clients will continue to receive advanced notice—no less than 5 months—before any such changes take full effect. Users who prefer to self-host may request access to the full project source code, as outlined in Section 6 of these terms. Any additional adjustments to hosting resources or related service terms will be communicated with a minimum of 3 months' notice.

11. Shop Hosting and Data Restoration Policy

For ecommerce or shop-based websites, hosting fees will be charged at a rate that never exceeds what the client would pay independently. Specifically, hosting fees will be capped at $24 per month (approximately 3,000 ISK per month for a 12-month period) for a React shop hosted on Vercel. Should Vercel adjust its pricing, hosting fees will be adjusted accordingly.

In the event that a client fails to pay the hosting fee by the due date, Sky Faze will shut down the website after 2 weeks from the missed payment deadline. The website data will be retained in our data storage.

Should the client wish to have their website data restored or backed up on their own domain, a restoration fee will apply. A fee of 10,000 ISK will be charged if restoration is requested within the first 3 months after shutdown. Requests made after 3 months will incur a fee of 100,000 ISK.

12. Amendments and Modifications

Terms and conditions may be amended or modified. Clients will be notified via email of any changes.
